Lien Waiver Generator

A lien waiver is a document a subcontractor or GC signs that says, in effect, "I've been paid this amount, and I'm giving up my right to file a mechanic's lien for it." GCs collect one from every sub before releasing payment. It's the paperwork that turns a check into a clean, unencumbered payment for everyone downstream.

Two questions decide which of the four waiver forms you need. Progress or final: does this payment cover one draw or the entire contract? Conditional or unconditional: does the release take effect once the check clears, or immediately on signing? Twelve states write the exact wording into statute, so the form has to match word for word or it can be challenged later.

California, Texas, Nevada, Arizona, Florida, Georgia, Michigan, Mississippi, Utah, Massachusetts, Wyoming, and Missouri all write the lien waiver's exact language into state statute. Sign anything else in these states and a court can treat the waiver as void. Mississippi and Wyoming go a step further: the waiver also has to be notarized before it takes legal effect. We flag that on your result screen so you don't find out after the fact.

Every other state has no statutory form, so this tool fills in a standard waiver instead. It still does the job: it documents the payment and the release, it's just not bound to specific statutory language.
