Idaho lien waiver requirements

Idaho does not prescribe a waiver form, but a waiver of lien rights is only effective if backed by consideration.

The short version

Idaho's mechanic's lien law is at Title 45, Chapter 5. The chapter does not require a statutory waiver form. What Idaho does require is consideration: an express waiver of a mechanic's lien must be supported by valuable consideration to bind the claimant. Payment is the obvious consideration. A bare written waiver with nothing flowing back to the sub is not enough. On residential work, owners can demand that the GC collect waivers from every sub at the homeowner's expense.

Consideration is required

An express waiver of lien rights in Idaho must be supported by consideration. That usually means the payment itself. A waiver with no money moving and no other promise behind it can be voided.

Tie every waiver to a specific draw or final payment. Reference the amount and the through-date on the face of the document. That makes the consideration obvious if a sub ever argues otherwise.

Residential owners can demand waivers

On residential work, Idaho lets the homeowner or buyer require the GC to obtain lien waivers from every subcontractor, at the homeowner's reasonable expense. That is a statutory right of the owner, not a contract negotiation.

If you are the GC on a residential project, build that obligation into your subcontract template. Subs who refuse to sign waivers delay your draw. Subs who do sign keep the title clean for the eventual sale or refinance.

The payment loop and the 90-day clock

Idaho gives claimants 90 days from last work to file a mechanic's lien on most projects. That window drives when waivers need to be in your project file.

Send a conditional waiver with each pay app and an unconditional one after the payment clears. On the final draw, do both again. Past the 90-day mark with no recorded lien, your title is effectively safe.
