Hawaii doesn't prescribe a lien waiver form. The waiver still has to read like one.

What HRS Chapter 507 actually says about waivers

Part II of Chapter 507 covers who can claim a lien, how to file notice, and how to enforce the claim in court. It says almost nothing about waivers, which leaves the form open and the burden on you to write it cleanly.

Because there's so little Hawaii case law on advance waivers, you should treat each waiver as a contract drafted from scratch. State the dollar amount, the project address, the through-date, and the signer's lien rights being released. Vague waivers invite challenges later.

How to build a Hawaii lien waiver that holds

Borrow the structure from a statutory-form state. Use conditional progress, unconditional progress, conditional final, and unconditional final as four distinct documents. The conditional pair releases rights only when the check clears. The unconditional pair takes effect on signature.

Pair the unconditional forms with a plain-English notice telling the subcontractor not to sign before payment arrives. Hawaii doesn't require that warning, but it protects both sides and keeps the document honest.

The licensing check Hawaii lien claimants forget

HRS §507-49(b) blocks any contractor who needed a Chapter 444 license from asserting a lien if they weren't licensed when the work happened. That's a Hawaii-specific landmine.
