The short version
Delaware's mechanic's lien statute is Title 25, Chapter 27 of the Delaware Code. Section 2706 deals directly with waivers. Any contract, agreement, or understanding that waives the right to file or enforce a lien created under this chapter is void as against public policy. Written waivers delivered simultaneously with or after payment are the only ones that count. There's no statutory form.

Section 2706 and the pre-payment ban
Section 2706 says any contract, agreement, or understanding that waives the right to file or enforce a mechanic's lien is void. The statute spells out the only exception: a written waiver delivered at the same time as, or after, payment for the labor or materials.
That gives you a simple test for every waiver in your file. If the document predates payment, it's not enforceable. If it's signed alongside the check or after the check clears, you're inside the safe harbor.
What a Delaware lien waiver needs to say
Delaware doesn't prescribe a form, but the courts will only enforce a waiver that (a) clearly states the amount being released, (b) identifies the property, and (c) shows a definitive intent to waive lien rights. A signature on a generic invoice acknowledgment is not enough.
Use named conditional and unconditional waivers. State the project address, the dollar amount, the period covered, and a clean sentence releasing the §2706 lien right up to that amount.
Settling after a claim is already filed
Section 2706 also carves out written agreements to subordinate, release, or satisfy a lien made after a statement of claim has been filed. Those settlements are valid even if they happen outside the payment-for-waiver structure.
If a sub has already filed, treat the resolution as a settlement document, not a routine waiver. Get it signed, get it recorded, and tie it to the payment that closes the dispute.
