What this form does
The conditional final waiver releases all of the claimant's lien rights for the entire project, on the condition the final payment described actually clears. Send it with the last pay app. Once the sub signs and the check clears, the lien rights are released for the job.
When to use it
Send this with the final pay app, before the final check clears. The sub signs, you cut the check, and once the funds move, you're done with that sub on that project.
Most state statutes treat the conditional final as the safer of the two final-payment forms. It's the right choice unless the final payment has already cleared.
