Why generic templates fail in California
California is one of the strictest statutory-form states in the country. Civil Code §8132 says a waiver and release is only effective if it follows substantially one of the four prescribed forms. Use your own template and the waiver is void on its face.
The unconditional forms (§8134 and §8138) carry a mandatory bold warning telling the sub not to sign before payment is in hand. That warning is part of the prescribed text. Drop it and the waiver fails.

California lien waiver FAQ
Are non-statutory California lien waivers enforceable?
No. Civil Code §8132 prescribes the four waiver forms. A waiver that doesn't substantially follow that language is unenforceable. Generic DocuSign templates fail the substantial-conformance test.
Does California require notarization for lien waivers?
No. The four statutory forms do not require a notary. They require a signed claimant identification, the through-date or final-payment marker, and the dollar amount.
Which California form do I send for a progress payment?
Send conditional progress under §8132 with the pay app. The lien rights release only when the check clears. After it clears, send unconditional progress under §8134 to close out that pay period.
Can I waive California lien rights in advance in the GC contract?
No. California voids any waiver of lien rights signed before the work is performed. Each waiver has to be tied to a specific payment, signed contemporaneously.
