The short version

Maine's mechanic's lien statute is at 10 M.R.S. §§3251-3269. It creates the lien for anyone who labors at or furnishes materials for a building, and sets the procedure to perfect it. There is no statutory waiver form. Maine doesn't ban advance lien waivers outright, but Maine courts disfavor them, so payment-conditioned waivers are the cleaner path. Both conditional and unconditional waivers are accepted.

Where Maine's lien law starts and stops

Section 3251 establishes the lien for labor, materials, and services used in erecting, altering, moving, or repairing a building. The remaining sections cover how the lien is preserved, enforced, and released. None of them give you a waiver template.

That leaves your contract and your waiver form as the only paper between you and a lien claim. Make both of them clean, specific, and dated. Maine doesn't carry you on this one.

Why advance waivers are risky in Maine

Maine has no statutory ban on waiving lien rights in the contract before work begins. But Maine courts have leaned hard against enforcing those clauses. If a sub goes unpaid and points to an advance waiver buried in the subcontract, expect a judge to ask whether the sub knew what they were signing.

Skip the upfront waiver. Use conditional waivers tied to actual progress payments. The paper trail is stronger and the document is much harder to attack.

Releasing the lien after payment

Maine's statute doesn't set a deadline for releasing a recorded lien after payment, and it doesn't prescribe the release form. Once the claim is satisfied, the claimant should record a written release or satisfaction in the same registry of deeds where the lien sits.

If you're the GC, get the release in writing the day you pay the final balance. Don't assume the sub will record it on their own timeline. Title companies will ask.
